While the majority of our practice is dedicated to avoiding or minimizing post-death administration (whether through probate or a trust administration), we regularly assist with post-death administration issues.

To that end, we help families prepare for and navigate the emotional and often tedious post-death estate administration process. Our services include reviewing estate documents, advising personal representatives (i.e. executors) and trustees regarding their fiduciary duties, help fiduciaries identify and gather estate/trust assets and identify debts, notify qualified beneficiaries of their interests in an estate or trust, allocate and divide assets, and distribute trust assets to qualified beneficiaries.

While doing so, we also provide advice on the income and estate tax consequences of death and potential ongoing trust administration, and perhaps most importantly, assist with arbitrating disputes regarding the inevitable tension between family members that may develop because of the intersection of money, family dynamics/history, and honoring the deceased persons wishes.
